These Terms and Conditions of Service apply to all services and users of the Bavariabrau.com website, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.
Please read these Terms and Conditions carefully before using our website. If you do not agree to all the terms and conditions then you may not access the website or use any services.
You can review the most current version of the Terms and Conditions at any time on this page. We reserve the right to update, change or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes.
These Terms and Conditions, also any Contract that is formed between us, are only in the English language and are governed by English law. Therefore a Contract for the purchase of Products made through our website and any dispute or claim arising in connection with it will be governed by English law.

- Age Restrictions
All customers must be over the age of 18 years to purchase alcohol from our shop as it is an offence to do so otherwise. It is also an offence to purchase alcohol on behalf of a minor. By purchasing from us, you are confirming that you are over the legal age of 18 years old.
Where alcoholic products are to be delivered as a gift, the recipient of the goods should also be 18 or over. If there is any doubt then our courier may request some form of I.D. from the purchaser or recipient. If they are not satisfied that they are over the legal age to buy alcohol they will not leave your order.
Prices are clearly shown on the website next to each item. All costs are quoted in pounds sterling and include VAT. Delivery costs are only added once customers visit check-out, which will be charged at the rates mentioned in the delivery section of this website. We reserve the right to change prices without prior notice.
Our site contains a large number of Products. It is always possible that, despite our reasonable efforts, some of the Products on our site may be incorrectly priced. We will normally check prices as part of our dispatch procedures so that where the Product's correct price is less than the price stated on our site, we will charge the lower amount when dispatching the Products to you. However, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mispricing, we do not have to provide the Products to you at the incorrect (lower) price.
The total price payable will be stipulated at the time when you place your order whether or not the order has been acknowledged. We are entitled to make adjustments to the price if due to an error or omission the price published for the products is wrong whether or not the order has been acknowledged. In this event we will inform you of the correct price and give you the opportunity to cancel the order.
- Ordering and Sales
Our shopping pages will guide you through the steps you need to take to place an order with us. Our basket and order confirmation pages allow you to check and amend any errors before submitting your order to us. Please take the time to check and confirm your order at each step of the order process.
After you place an order, you will receive an e-mail from us acknowledging that we have received your order. However, please note that this does not mean that your order has been accepted.
We will only confirm our acceptance to you by sending you an e-mail notification that confirms that the order has been dispatched. You are entitled to amend your order after it has been placed but before the Dispatch Notification is sent. If you wish to amend your order please e-mail email@example.com.
Once confirmed, your order is sent directly to our secure warehouse for processing. Once we have received your order and payment, our staff will pick, pack and dispatch the item. We will aim to do this the same day for all orders received before 13.30. However during busy times this may extend to longer. Our courier will then collect your order from 15.00 Monday to Thursday for next working day delivery. Orders dispatched on Friday pm will be delivered on the following Monday.
If we are unable to supply you with an order we will immediately inform you of this by e-mail and we will not process your order. If you have already paid for the order, we will refund you the full amount including any delivery costs charged as soon as possible.
We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e‑mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.
You agree to provide current, complete and accurate purchase and account information for all purchases made at our online store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates, so that we can complete your transactions and contact you as needed.
Full details are available in our Deliveries Policy. Orders over £50 will have FREE delivery provided that goods are being delivered to a single recipient at a single UK delivery address (subject to courier conditions for remote locations).
Orders up to the price of £50 will attract a delivery charge from £4.95 provided that goods are being delivered to a single recipient at a single UK delivery address (subject to courier conditions, please read the Delivery Policy).
If no one is available at your address to take delivery, the delivery driver may attempt to leave it in a safe place or with a neighbour. If this is not possible, a card will be left with details of any rescheduled delivery date (if applicable) or alternatively how to collect or rearrange your delivery. Should any order be returned to us and you made no attempt to contact us or the courier regarding delivery, we will be entitled to charge a standard delivery charge to re-send the order.
Delivery of an Order shall be completed when we deliver the Products to the address supplied when ordering and the Products will be your responsibility from that time.
We do not accept any responsibility for delayed or failed delivery of a Product which results from your failure to provide correct address information. If a Product is returned to us because you fail to provide correct address information, we reserve the right to require that you pay additional postage costs (and administration fees and taxes, if applicable) before we re-deliver the Product.
The Company will use their reasonable endeavours to deliver goods promptly but cannot accept any liability for delay in delivery for any cause.
5.1 No International Delivery
Unfortunately, we do not deliver to addresses outside the UK. You may place an order for Products from outside the UK, but this order must be for delivery to an address in the UK. We do deliver to the Scottish Highlands & Islands, Channel Islands, IOW, IOM and Northern Ireland, but this is on a special delivery basis and prices are available upon request (subject to courier conditions, please read the Delivery Policy).
We accept payments by PayPal, ApplePay, Maestro, Visa Delta, Visa Electron, Visa Debit, Visa and MasterCard. Credit cards are charged at time of placing order via this website. When you give us your credit or debit card details you are confirming that you are either the card holder, or that you have permission from the card holder to use the card to order from us.
We use the best encryption systems available to ensure your credit card details are secure; all credit & debit cards are authorised by Sage Pay. Sage Pay is an intermediate party who provide secure on-line payments and are approved with the majority of UK acquiring banks.
Payment for the Products and all applicable delivery charges is in advance.
All payments are managed securely by our trusted third party payment provider.
6.1 Brau Klub Membership and Payments
The price of your Brau Klub membership is as quoted on our website www.bavariabrau.com Prices stated include VAT
You will receive an email confirmation confirming you Brau Klub membership and confirming the payment schedule of your Brau Klub membership monthly fees.
We take payments by continuous payment authority. You will be charged for your Brau Klub membership on the anniversary of your membership start date.
Payment times will vary in the approach to a bank holiday, when we may take payment up to 3 days earlier.
You agree not to hold us responsible for banking charges incurred due to payments on your account.
Your beers will be dispatched within 24 hours of your club membership fee clearing our bank account.
6.2 Brau Klub Cancellation Policy
You can cancel or pause your Brau Klub subscription at any time by sending an email to firstname.lastname@example.org
If you cancel your subscription 4 days or less prior to your Club Membership start date you will still be charged for your club membership and the beers sent out accordingly.
Our packages are designed to be extremely safe and secure. Our preferred courier service, ACL, provide us with a specialist bottle delivery service, which tracks and takes extra care of delicate goods. If you do find a bottle has broken or been damaged please contact us within 48 hours so that we can investigate the situation as promptly as possible. This does not affect your statutory rights.
- Refunds (if applicable)
If you are not 100% happy with the goods you have received, you have the right to return them in their entirety to us. You will be responsible for the return delivery charge and any damaged / missing goods. Upon receipt of the returned goods we will credit your account minus the initial delivery charge.
We are happy to offer a full refund if you notify us within 14 days of the order being received. All items must be returned unopened and in a resalable condition, with proof of purchase.
You are responsible for any charges incurred for shipping the items back to us. Our courier, ACL, can collect the goods for return, at your expense. Please contact us for a quote. Refunds will be issued to the card used for payment once the items have arrived back with us and have been examined.
Once your return is received and inspected, we will send you an email to notify you that we have received your returned item. We will also notify you of the approval or rejection of your refund.
If you are approved, then your refund will be processed, and a credit will automatically be applied to your credit card or original method of payment, within a certain amount of days.
- Cooling Off Period
Under the Distance Selling Regulations, you may cancel a distance contract to purchase a product or products from us at any time within 7 working days after the day you received the relevant product or products (subject to the limitations set out below).
In order to cancel a contract in this way, you must give to us written notice of cancellation. This can be done by email to email@example.com quoting your order reference number, full name and address.
If you cancel a contract on this basis, you must promptly return the products to us, in the same condition in which you received them. Items must be returned in their original packaging and in re-saleable as new condition.
If you cancel a contract on this basis, you will be refunded in full the cost of the goods. However, we are unable to refund any initial outbound delivery charge you have paid, and you will be responsible for paying the cost of returning the product to us.
Please be mindful that until the product is safely returned to us it is your responsibility to ensure it stays in perfect condition. Returned items will be fully checked and photographed on return. Any items that are received by us in a damaged condition will not be eligible for return or refund.
- General Terms:
These terms are subject to English law and you, the purchaser or recipient and we, the Company accept the exclusive jurisdiction of the English courts in connection with any disputes. Headings are not to be used in the constructions of this Agreement. These terms and any document referred to in them are the entire agreement between us and may only be varied as stated in these terms or by agreement in writing. Our failure to enforce a right does not amount to waiver of it. You may not assign or transfer your agreement with us to any third party.
10.2 Intellectual Property Rights
All Copyright, database rights, trademarks, and any other intellectual property rights in and to the content on this website, such as website design, text, graphics, images, the selection and arrangement thereof and all software compilations, underlying source code, software (including applets) and all other material on this Website is the sole property of Bavaria Brau Ltd. ALL RIGHTS RESERVED. Any use, including copying, reproduction, duplication, transmission or display of content of this website without the express written permission of Bavaria Brau Ltd for purposes other than the viewing of information or for ordering purposes, is strictly prohibited.
10.3 Limitation of Liability and Force Majeure
The company shall not be liable for loss or damages of any kind, including without limitation special or consequential damages, arising out of your access to, or inability to access, this site or your use of, or reliance upon, this site or the content hereof or for negligence (except for personal injury or death) and excludes any such liability to the fullest extent permitted by law.
We are not liable for damage caused by customer mishandling goods, such as breakages and spillages.
The following warnings about alcoholic products should be noted:
- Beer is a form of alcohol so it must be drunk moderately and responsibly.
- Extra care should be taken when transferring beer bottles and glasses. We recommend that you transfer them no more than two at a time to avoid accidents.
- Beer can cause stains so extra care should be taken to avoid spillage.
- Beer can be volatile so be careful when opening the bottles.
We are not liable for breach of this Agreement for any loss or liability arising from circumstances of force majeure and other circumstances beyond our reasonable control such as Act of God, Government regulation or order, fire, theft, flood, strike, riot, insurrection, war, national emergency, power shortage, pandemic, terrorist activity.
10.4 Your Statutory Rights
Nothing in the Terms and Conditions of Sale shall affect the Statutory Rights of the Purchaser. Further advice about your legal rights is available from your local Citizens' Advice Bureau or Trading Standards office.
10.5 Notification of Changes to Terms and Conditions of Service
We regularly review our Terms and Conditions of Service and they are subject to changes. Any future changes we make to this Policy will be posted here. It is your responsibility to check our website periodically for changes. Your continued use of or access to our website or the Service following the posting of any changes to these Terms and Conditions of Service constitutes acceptance of those changes.
